Patios - Residential
This guideline has been developed to assist you in your efforts to design and construct a Patio. Prior to constructing a patio, a permit from the City of Wheaton Building Department is required. Provided below is information that addresses what information you need to submit to the City, including pertinent building codes, zoning setback requirements, permit fees and required inspections. These guidelines are by no means all-inclusive, but they do identify the most critical requirements that are involved in this type of project. Please review this information and contact us if you should have any questions.
The following documents need to be submitted to initiate a review of your project:
- Application for Permit
When filling out the application for a permit, include all required information that is pertinent to the proposed scope of work such as; site address, description of work, contractors to be used on the job and their respective costs per trade, total cost of work to be performed, complete applicant contact information, etc. Please refer to document titled Building Application for Permit.
- Architectural Plans
If there are any structures that will be built in conjunction with the patio (such as a deck or pergola), please submit two (2) complete sets of architectural plans and any other required documentation that will be necessary to complete the review of the construction documents.
- Plat of Survey
Please provide two (2) copies of a current Plat of Survey with the proposed patio and any other features drawn to scale on the plat of survey. Indicate distance of the proposed patio (and any other features) to all adjacent side and rear lot lines and any accessory structures. Patios are not allowed in front yards.
- Townhouse or Condominium Association Approval
Provide a letter from your townhouse or condominium association president (if applicable) that identifies that they have reviewed your proposed deck and location within the townhome subdivision and have approved it.
Significant Codes - Zoning - Please refer to Wheaton Zoning Ordinance 24.4.3
- Front and corner side yard setback: Same as required for house
- Rear Yard Setback: 25 feet
- Side Yard Setback: 8% of lot width per side (but no more than 10 feet)
- No setback for stairs under 4 feet above grade
Architectural Plan Requirements
Construction of any associated features (such as a Pergola, Deck, Gazebo, etc.), require the submittal of two (2) copies of Architectural Plans that indicate the following information:
Please provide the materials that the patio will be constructed with. Please include the material thickness, base material and thickness, dimensions of the patio and any stairs or landings, and any other features that will be installed.
Stair and Landing Details
Please indicate stair riser height (maximum 7-3/4”) and tread depth (11” minimum measured from the nosing of the treads). Elevation of new patio should ensure that any adjacent existing stairs maintain consistent riser height. Landings are required on the exterior side of any exterior doors that either swing outward or have more than two risers in the stairway that serves the door. These landings must be a minimum of 36" deep in the direction of travel, must be a minimum of the width of the door served (not to be less than 36" in width), and have a maximum riser height to the door threshold of 7-3/4".
Decks, Pergolas, Gazebos, and Similar Structures

Gas Fire Features
Please provide two sets of plans that indicate the structure that will support/surround the fire feature, the size, and type of the gas line that will serve the fire feature, the location of the gas shutoffs, and the manufacturer’s installation specifications for the proposed fire feature. The fire feature and all associated elements serving the feature must be listed and labeled for such use. Gas fire features must be a minimum of 10’ from the side and rear lot lines and must follow the manufacturer’s specifications for clearance to combustibles.
Open Burning Fire Pits
Please provide two sets of plans that indicate the design/construction of the fire pit. Fire pits must be a minimum of 30’ from anything combustible, and a minimum of 10’ from the side and rear lot lines (not allowed in front or corner side yards).
Barbeque Grills and Kitchens
Please provide two sets of plans that indicate the structure of the kitchen, or the structure that will support/surround the barbeque grill, the size, and type of the gas line that will serve the barbeque grill, the location of the gas shutoffs, and the manufacturer’s installation specifications for the proposed grill. The barbeque grill and all associated elements serving it must be listed and labeled for such use. Kitchens and barbeque grills must be a minimum of 10’ from the side and rear lot lines and must follow the manufacturer’s specifications for clearance to combustibles.

To schedule an inspection
Please call 630-260-2050 between 8 a.m. and 5 p.m. Monday through Friday. Plumbing inspections are available on Tuesday or Thursday only. Please allow for a minimum of 24 hours notice when scheduling inspections. Inspections must be scheduled no later than 3:30 p.m. the day before the desired inspection date.
