Demolition Guidelines

The information assembled will assist you to demolish a structure in the City of Wheaton. It contains regulations and procedures established by the City of Wheaton and identify regulations established by other applicable governmental agencies. As you will see from the number of forms and documents there are numerous regulations in place to protect the public’s interest and welfare.

We recommend you become familiar with this Demolition Guideline, the Wheaton City Code, Article XIV Demolition of Buildings, as well as referenced documents. Once you have read through this guide please do not hesitate to contact one of our Permit Processors at 630-260-2050 with any questions you may have. Our office hours are Monday through Friday, 8:00 a.m. until 5:00 p.m.

Prior to demolition, we strongly recommend that you contact the Planning Department at 630-260-2008 and talk to the Director of Planning to determine if the proposed site and construction will entail any zoning variance issues that may require specific approval from City Council. Be advised that proceeding with site demolition, before checking to see if what you intend to build is in accordance with City ordinances, is strictly at your own risk.

Based on our discussions with developers it is our understanding that demolitions proceed through multiple and distinct phases with specific activities and procedures taking place during each phase. We have tailored our processing around these phases and have organized them as follows:

Phase I - Preparing Site for Demolition

The following activities can be performed in advance of obtaining a demolition permit. When preparing the site for demolition as identified below new hazards may be created, if so, the property owner shall take measures to abate these hazards.

While you are preparing the site we highly recommend that you proceed with applying for a Demolition Permit as identified in “Phase II” of this guideline. Also at this time, if you are planning to re-build on the site, we recommend that you apply for a Building Permit at the same time that you have applied for a demolition permit. Procedures for constructing a single-family residence are outlined within “Phase VI: Applying for a Building Permit which is contained in this guideline. Activities that shall be performed in advance of obtaining a demolition permit include:

  1. Homeowner Informational Meeting (Please note that this is mandatory)
    1. The applicant shall meet with the abutting property owners thirty (30) days prior to applying for a demolition permit and fill out the form titled Documentation of Meeting with Abutting Neighbors. The applicant shall provide each owner with a copy of the proposed site plan, building elevation plan, traffic control plan for the project and City-prepared handout titled Demolition & Construction Site Regulations.
    2. Inform each abutting property owner regarding the scope of work, the timetable for the work, special instructions to protect their property, and in general terms, any other information that may be relevant regarding the project.
    3. Fill out name, address, PIN, and signature of meeting attendees on “Documentation of Meeting with Abutting Neighbors”.
  2. Water and Sewer Disconnect Permit
    A permit is required to disconnect the water and sanitary water service lines from the City water and sanitary sewer mains. The disconnection is required to be performed and inspected prior to demolition of the structure.
    1. Complete Engineering - Application for Permit.
    2. This permit requires a $75.00 fee for the inspection of water disconnection and a $75.00 fee for the sewer disconnection inspection.
    3. Provide a marked-up plat of survey indicating the location of existing water and sanitary service lines. If a new structure is proposed to be constructed within (45) days of demolition, a temporary disconnect can occur at the Parkway as approved by the Engineering Department.
    4. See Contractor Requirements and provide contractors name, address, and phone number on the application.
    5. Provide the sewer and water contractor’s certificate of insurance.
    6. Provide the sewer and water utility contractor’s bond in the amount of $10,000.
    7. PRIOR TO BACKFILL, call the Engineering Department at 630-260-2040 for an inspection so that the required permanent (or temporary) disconnection, of the water and sanitary service lines can be completed.
       
       
  3. Utility Lines
    Electrical, natural gas, phone, and cable television lines shall be disconnected prior to demolition of building as long as the disconnections are in accordance with the utility company requirements. See and fill out the form titled Utility Disconnect Form which includes a list of utility company names, and phone numbers to allow you to schedule the various disconnect. Return the completed Utility Disconnect Form to our office when all utilities have been disconnected at the time of issuance of the demolition permit.
  4. Water Meter
    Contact the City of Wheaton Water Division at 630-260-2090 to schedule the removal of the City Water Meter.
  5. Asbestos Inspection
    All single-family dwellings and multi-family dwellings containing 3 units or less proposed for demolition shall be examined by an Illinois-licensed Asbestos Building Inspector at the owners’ expense who shall inspect all accessible areas of the dwelling proposed for demolition to determine if asbestos-containing building materials are present. The inspection shall include, but not be limited to, pipes, beams, walls, ceilings, floors, furnace, boiler, water storage tank, wall panels, insulation, siding, roofing, and other potential asbestos-containing materials. A copy of the inspector’s license and report certifying the condition of the premises shall be submitted with the demolition permit application. In the event that suspect asbestos is found at the property, laboratory testing shall be performed, and if regulated friable asbestos material is present, removal and disposal of the asbestos shall be undertaken in conformance with all applicable laws, rules, and regulations. Any plan for removal and disposal shall be confirmed in a report submitted to the City by the applicant’s Illinois-licensed Asbestos Building Inspector. The City Director of Building and Code Enforcement may in his/her discretion submit the findings of any such inspector for review by an environmental consultant of its choice prior to the approval of demolition permit. The review costs by any environmental consultant retained by the City shall be paid by the demolition permit applicant prior to issuance of the demolition permit.
  6. Well or Septic (if present on existing site)
    If the property has a water well it must be filled, and a certificate provided by a certified well contractor, in conformance to the regulations established by the DuPage County Health Department. Once the work is complete provide us with a copy of the County Well Certification. Call 630-682-7400 for further information. Pump effluent from septic tanks and provide a copy of the receipt to our department. Identify the location of the tank on the plat of survey and indicate if the tank will be removed or crushed and backfilled.
  7. Post Sign
    The Building and Code Department will provide two “brightly colored (orange)” signs for you to post at the demolition site that identifies the date of demolition. The sign shall be posted a maximum of ten days prior to and no less than three days prior to demolition.
  8. Meeting to review demolition and construction regulations
    An in-office meeting is required to be conducted between a City representative and demolition contractor to review the demolition and construction regulations of the City. See guideline titled Demolition and Construction Site Regulations. Contact a Permit Processor at 630-260-2050 to set up a meeting prior to demolition.
  9. Fencing and Portable Toilet
    1. Chain link fence, tree protection fence, silt fence, and portable toilet can be installed no sooner than 10 days prior to demolition of a structure. Installation of items listed above shall be per the approved site plan.
    2. Install 6’ chain-link safety fence
    3. Install tree protection fencing per approved site plan.
    4. Install silt fencing and other stormwater management methods as per the approved site plan.
    5. Place portable toilet facility behind front lot line, centered on the lot.
  10. Contacting Fire and Police Departments
    The Wheaton Fire and Police Department are interested in utilizing buildings that are proposed to be demolished for “real life” training purposes. If you are interested in allowing your building to be utilized for training please contact the Police Patrol Commander at 630-260-4863 and Fire Battalion Chief at 630-260-2171. Each respective department provides a “Training Liability Waiver” to address liability concerns. Please note that training shall not occur until such time that the demolition permit has been issued, posted on-site and chain link fence has been installed.
  11. Grass Regulations
    Grass and or weed height shall not exceed eight (8) inches.
  12. Secure Site
    All openings of vacant buildings including all exterior doors, garage doors, windows, or any other similar openings, shall be closed and/or locked, or otherwise secured.
  13. Demolition Salvage Sales
    The salvaging of building and landscaping material from the proposed demolition site, by the property owner or owner's representative, is not restricted by City Codes. However, when doors and windows are removed, the openings must be secured by board up and/or fencing the property. We recommend that the removal of building materials occur during the time that the property is enclosed with the 6’ chain link fence. If done too far in advance of demolition the property can be cited for property maintenance violations.

Phase II - Applying for a Demolition Permit

Thirty (30) days after the developer meets with adjacent property owners an Application for Permit can be submitted for the demolition of a building. Assemble the following documents listed below and submit them together in one complete package to the Wheaton Building Department. A Permit Processor will review the submittals if correct and complete they will be accepted and the second 30-day review period begins. The second 30-day review period is waived if the demolition was previously approved by City Council during a zoning approval. For demolitions that have not been approved by City Council through a zoning approval, the Permit Processor will send out letters to all abutting property owners and direct Public Works to post a sign that notifies neighbors of the proposed demolition.

Submittal of an Application for Permit (for demolition) initiates a review from the Planning, Engineering, Building, and Water Division. Review comments are assembled in a so-called “plan review” and forward to you for correction and or response. All plan review comments need to be responded to by you or your design professional and returned to the Permit Processor for a second review. When all items are in compliance with the City codes we can issue a demolition permit, it is at this time that any applicable fees are collected.

A one-sheet checklist has been assembled to assist you and staff with the numerous submittals required, this checklist is titled Demolition Checklist.

Items to be submitted for review include:

  1. Application for (Demolition) Permit.
    1. Complete a Building Application for Permit, making sure to indicate the following:
    2. Address of proposed demolition;
    3. Name, address, and phone number of the legal property owner;
    4. Description of work (identify all structures to be demolished);
    5. Demolition Contractor’s name, address, phone number.
  2. Documentation of Meeting with Abutting Neighbors.
    Submit the Documentation of Meeting with Abutting Neighbors that identifies you have conducted a meeting with the abutting property owners 30 days prior to applying for a demolition permit.
  3. Architectural plans for re-use of the subject property.
    If construction is to begin within 45 days of demolition, submit one set of architectural plans of the proposed structure that is to be constructed on the subject property.
  4. Plat of Survey
    Submit two copies of the plat of survey that depict:
    1. Address of property;
    2. Legal description;
    3. Highlight all structures that are to be demolished, indicating the location of the new structure
  5. Demolition Plan
    Provide two (2) copies of the site plan for demolition that meets all of the specifications listed within the Demolition Plan Requirements. This site plan is applicable for lots that are proposed to be vacant or for new construction.
  6. Tree Preservation Survey
    See Wheaton Zoning Ordinance Article 6, Section 6.11Tree Preservation which identifies minimum tree preservation requirements. Information required includes tree survey, tree preservation plan, and preservation methodology for desirable trees with a 6” diameter or larger trunk. Also, see Tree Preservation Species List for a list of desirable trees. Tree survey should be in chart form that identifies trees by; tree reference number, species, girth size, and tree condition. Tree survey should indicate: location of trees, location of tree protection fencing, storage of vehicles, storage of materials, no grading areas, and similar. Preservation methodology should reference methods used to preserve trees (example, snow fence). Tree survey can be a separate plan or included on Demolition Plan, see item #5 above.
  7. Stormwater Management Plan (grading survey)
    Refer to Grading Plan Requirements - Type II for information to be provided on the grading survey labeled Storm Water Management Plan. Information shall include soil erosion control and grading of the subject property. Indicate silt fencing, including a detail of the installation.
  8. Storm Water Management Permit Application
    1. A DuPage County Stormwater Management Certification Application is required to be filled out when more than 5,000 square feet of the surface area of the lot is disturbed and/or as required by the Engineering Department.
    2. An escrow deposit of $3,500 is required to ensure that erosion control measures are installed and to protect City property from damage. The escrow is returned once all vegetation, utilities, and other items required by code have been addressed.
  9. List of Adjacent Property Owners
    Form titled Sworn Affidavit of Adjacent Property Owners is to be utilized when listing the names and addresses of all abutting property owners to whom tax bills were sent for the general taxes for the last preceding year and all real estate immediately adjacent to and across the street from the property on which the demolition is requested. The applicant shall file a sworn affidavit with the list of taxpayers certifying that the list is complete and accurate. Building staff will send letters to all adjacent property owners identifying that demolition is pending.
  10. Traffic Control Plan
    Submit a plan depicting the following information:
    1. The subject property;
    2. The surrounding roads, lots, and parking lots;
    3. The location of where construction vehicles and workers will be parking during the demolition/construction of the structure;
    4. Any construction traffic staging that will take place during the demolition and or construction of the structure;
    5. Location of portable toilet and material storage.
An aerial view of the subject property can be provided by staff for you to mark up with the information requested above.
  1. Drive Approach Permit
    A Curb, Driveway and Public Walk Application for Permit is required for the removal of any existing drive approach curb, and/ or public sidewalk. A second Drive Approach Permit will be issued for the new drive, approach, curb, and/or public sidewalk.

    The DuPage County Stormwater Management Permit requires that any demolition or construction project provide a hard surface, such as gravel or similar, be provided for construction vehicles and is meant to minimize mud on streets and sewers. If existing approaches and driveways are removed you must maintain a gravel surface.

    If the lot is to remain vacant all drive approaches, including abandoned drive approaches, must be removed and the City parkway restored with approved vegetation. Depressed street curb must be removed and replaced with a street curb that matches the existing street curbing on the adjacent street. The fee for this permit is $75.00.
  2. Asbestos Inspection
    All single-family dwellings and multi-family dwellings containing units or less proposed for demolition shall be examined by an Illinois-licensed Asbestos Building Inspector at the owners’ expense who shall inspect all accessible areas of the dwelling proposed for demolition to determine if asbestos-containing building materials are present. The inspection shall include, but not be limited to, pipes, beams, walls, ceilings, floors, furnace, boiler, water storage tank, wall panels, insulation, siding, roofing, and other potential asbestos-containing materials. A copy of the inspector’s license and report certifying the condition of the premises shall be submitted with the demolition permit application. In the event that suspect asbestos is found at the property, laboratory testing shall be performed, and if regulated friable asbestos material is present, removal and disposal of the asbestos shall be undertaken in conformance with all applicable laws, rules, and regulations. Any plan for removal and disposal shall be confirmed in a report submitted to the City by the applicant’s Illinois-licensed Asbestos Building Inspector. The City Director of Building and Code Enforcement may in his/her discretion submit the findings of any such inspector for review by an environmental consultant of its choice prior to the approval of demolition permit. The review costs by any environmental consultant retained by the City shall be paid by the demolition permit applicant prior to issuance of the demolition permit.
  3. An IEPA Form (if applicable):
    Fill out and provide a copy of the Illinois Environmental Protection Agency (IEPA) Notification of Demolition and Renovation form that was mailed to the IEPA to Springfield as required by IEPA. Per IEPA regulations, demolition cannot occur until ten (10) days after the mailing date.
  4. Utility Disconnect Form
    Complete and submit a Utility Disconnect Form which indicates that the utilities including; electricity, natural gas, phone, cable TV, City sewer, City water, have all been disconnected in accordance with the utility company's requirements, and disconnections have been confirmed by the applicant.
  5. Water and Sewer Disconnect Permit
    A permit is required to disconnect the water service line and building sewer from the City water and sewer mains, the following items are required:
    1. Complete Engineering - Application for Permit;
    2. A $75.00 inspection fee is required for each utility disconnect;
    3. Provide a marked-up plat of survey indicating the location of the existing water service line. If a new structure is proposed to be constructed within 45 days of demolition, a temporary disconnection can occur at the water shut off valve (B-box) if approved by the Engineering Department;
    4. Provide proof of insurance for excavating/sewer & water contractor;
    5. Provide bond in the amount of $10,000;
    6. Disconnection of the water service line is required to be inspected prior to backfill. Contact the Engineering Department at 630-260-2040.
  6. Dust and Particulate Control
    Control of dust can be achieved by watering debris from water obtained from a City hydrant or water brought in via a water tanker truck, either method requires verification.
    City Hydrant: The demolition contractor may utilize City water for dust control, a fire hydrant meter (and deposit receipt must be obtained from the Water Division at 210 Reber Street). A required deposit of $700.00 will be paid at and refunded by the Water Division upon return of the hydrant meter and payment of water bill, or;
    Tanker Truck: The demolition contractor may provide a tanker truck with a pump capacity of 100 gallons a minute. Provide the name, address, and phone number of the entity supplying the tanker. This information is to be indicated on the permit application. The water must be delivered from the source by a hose with a minimum diameter of one and one-half inches.
  7. Safety Fencing and Portable Toilet Requirements & Inspection:
    1. A minimum 6’ high temporary chain link safety fence must be installed and maintained around any and all structures to be demolished. This fencing is to be installed no more than seven days prior to demolition. Gates to the fence shall be closed and secured with a lock at the end of the day.
    2. The site shall be provided with portable temporary restroom facilities in the manner provided by the Illinois Construction Site Temporary Restroom Facility Act, 410ILCS 37/10. The location of the public toilets(s) shall be located (in the front yard) as close to the center of the lot as possible and away from the adjacent properties, and shall not be placed on City right-of-way, including but not limited to, parkway or sidewalk.
  8. Certification of Well Abandonment and Sealing (if applicable):
    Provide a copy of DuPage County Health Department certification that the well has been filled in conformance to their regulations, contact phone 630-682-7400.
  9. Septic Tank Clean Out Receipt
    Provide a receipt that identifies that the septic tank has been pumped of all effluent. Identify the location of the tank on the plat of survey and indicate if the tank will be removed or crushed and backfilled.
  10. Applicants Bond
    The Applicant (Owner or Owner’s Representative) shall post a cash demolition bond with the City or an Irrevocable Letter of Credit Sample from your lending institution in the amount of 3% of the cost of demolition or $10,000, whichever is greater. If an irrevocable letter of credit will be provided, the wording needs to be identical to the sample provided.
  11. Contractor Requirements
    In order to perform work in the City of Wheaton, certain contractors are required to be registered with the City of Wheaton including demolition contractors, sewer and water contractors as well as concrete/asphalt paving contractors all of which perform work in the City right-of-way. See Contractor Requirements. Each of these contractors is required to provide the following:
    1. A surety bond in the amount of $10,000;
    2. $1,000,000 Certificate of Insurance;
    3. $75.00 registration fee.
  12. Summary of Fees and Deposits

Phase III - Prior to Starting Demolition

  1. Call the Building Department at 630-260-2050 at least 24 hours prior to demolition to schedule an inspection to verify the following:
    1. Safety Fence. A 6’ high chain-link safety fence is required to be installed; this fence is required to be installed no more than 7 days in advance of the demolition of the structure;
    2. Tree protection. Tree protection must be installed no more than 7 days in advance of the demolition of the structure making sure that the installation is at the periphery of the tree’s drip line to protect trees from root compaction by the storage of materials or vehicles. Trees on City property that are adjacent to the development are to be protected as identified above. Removal of tree protection fencing can be completed after demolition and only after any proposed construction is also completed;
    3. Silt fencing. Silt fence must be installed properly and in place as identified by the Design Engineer and approved by the Engineering Department;
    4. Portable toilet. A portable toilet is required to be on-site prior to the permit issuance in the front yard in the center of the lot;
    5. Demolition date Signage. The required signage must be properly installed on-site, must identify the scheduled date of demolition, and can be installed no more than 10 and no less than 3 days prior to the scheduled demolition date.
  2. Schedule Sewer and Water Disconnection Inspections
    These inspections must be conducted prior to the issuance of the Demolition Permit. To schedule, contact the City of Wheaton Engineering Department at 630-260-2040. Please note that they require at least 48 hours advance notice.
  3. Notify J.U.L.I.E.
    Call 1-800-892-0123 a minimum of 48 hours before digging so that they can locate any underground utilities. This service is available 7 days a week, 24 hours a day.
  4. Waste Recycling
    In an effort to reduce demolition debris, a number of Counties, State, and Federal agencies have developed two reference guides entitled; “DuPage County Recycling Guide” and the “Illinois Construction and Demolition Site Guidebook”. More information about demolition waste recycling is available on the DuPage Website at www.dupageco.org or by contacting the DuPage County Solid Waste Division at 630-682-7000.

Phase IV - During Demolition

  1. Demolition & Construction Site Regulations
    Demolition activities are required to adhere to the regulations established in the Wheaton City Code, Ordinances, and Building Codes, referenced standards, as well as State and Federal laws. The staff has assembled an abbreviated version of pertinent regulations for your use during your demolition activities; it is referred to as the Demolition & Construction Site Regulations guideline.
  2. Post Permit
    The demolition permit must be posted at the front lot line.
  3. Watering Regulations
    Water the demolition and loading of materials at all times, failure to apply water to control dust can result in a court appearance and a fine from $2,000 to $5,000.
  4. Schedule Demolition Site Inspection
    Call the Wheaton Building Department at 630-260-2050 at least 24 hours prior to demolition to schedule an inspection and each day of demolition thereafter.

Phase V - After Demolition

  1. Enforcement of Site Restoration
    30 days after the demolition of a structure, City staff shall inspect the site to confirm if new construction has commenced or if the site has been restored as required by ordinance. The following steps must be taken to complete the demolition process and to restore the property as required:
    1. If new construction has commenced within 30 days.
      If construction has commenced within 30 days of demolition of the structure, no further action is required as long as the site is neat and clean and in compliance with the Demolition and Construction Site Regulations. The start of construction is defined as; excavation and concrete forming work for the new structure.
    2. If construction is proposed, but construction has NOT commenced within 30 days.
      If construction has NOT commenced within 30 days after demolition it will be in violation of the demolition ordinance. A Violation letter will be sent to the property owner identifying the violation. The letter will request a schedule and will provide the permit holder an additional 15 days to start construction. If construction has not occurred within 45 days after demolition, a citation will be issued. We strongly recommend that all permit applicants be prepared to start construction prior to demolishing a building. No additional delays will be given due to weather or winter conditions.
    3. If the site is to remain vacant, but restoration has NOT commenced within 30 days.
      If the site has NOT been restored within 30 days after demolition it will be in violation of the demolition ordinance. A Violation letter will be sent to the property owner identifying the violation. The letter will request a schedule and will provide the permit holder an additional 15 days to restore the site. If restoration has not occurred within 45 days after demolition, a citation will be issued. We strongly recommend that all permit applicants be prepared to start to restore the site prior to demolishing a building. No additional delays will be given due to weather or winter conditions.
  2. Definition of site Restoration 22-206 (g)
    Restoration of vacant property shall include:
    1. Disconnection of sewer and water mains:
      Permanent disconnection of sewer and water at the respective main is required if a lot remains vacant. Temporary disconnection of sewer and water is allowed if construction is to commence within 30 days. The sanitary sewer shall be plugged at or near the property line and inspected by a City inspector. The water service line can be cut on the house side of the water valve (B-box) and inspected by a City inspector.
    2. Final grading and seeding of the parcel:
      If the weather does not allow for final grading and seeding, the Code Official may allow rough grading until weather conditions permit final grading. Silt fencing and other stormwater measures shall remain in place in accordance with the DuPage County stormwater ordinance. However, the demolition bond shall not be returned until final grading and seeding have been completed.
    3. The removal of dangerous conditions, rubbish, and debris.
    4. The silt fence shall remain in place until vegetation cover is thriving.
    5. Restoration/replacement of any damaged public property such as, but not limited to; walks, curbs, road surface.
    6. Removal of safety and tree protection fencing.
  3. Refund of Stormwater Deposit
    Upon the completion of the site restoration or new construction, as defined above, a letter shall be sent to the Engineering Department (fax: 630-260-2195) requesting a refund of the $3,500 stormwater deposit. Upon approval, the Engineering Department will either refund the security deposit or notify the applicant to correct any deficiencies. If new construction, the escrow refund will occur at the time of completion of the project.
  4. Return of unused bond or irrevocable letter of credit
    Upon the completion of demolition and site restoration, as defined above, a letter shall be sent to the Building Department (fax: 630-260-2195) requesting a refund of the $10,000 cash demolition bond or a release of the irrevocable letter of credit.

    For those properties that have been issued a building permit for a new structure and construction has begun within 30 days of completion of demolition, items to be completed prior to the return of demolition bond shall include, but not limited to:
    1. Removal of all debris;
    2. Rough grading of the site;
    3. 6’ chain link (safety fencing), silt fence, and tree protection fencing in place and maintained;
    4. Temporary disconnection of sewer and water services;
    5. Sidewalks, streets, and parkways are clean and clear of obstructions.
  5. Silt fence removal
    Silt fences and other erosion control devices must remain in place, and be maintained until the final vegetation cover is established.
